Airtel Zambia Virtual Card Terms and Conditions
This Agreement contains the complete terms and conditions that apply to the Airtel Virtual Card and should be read together with theother Airtel Money Terms and Conditions applicable to you. By accepting these Terms and Conditions and participating in or continuing to use the Airtel Virtual Card you shall be deemed to be making an affirmative statement of your acceptance of these terms and conditions.
A. These Terms and Conditions (“Terms”/ Conditions of Use”) are applicable to the Airtel Virtual Cardholder and become effective once you activate a card through the Airtel selfcare mobile app and each time you use the Card.
B. You therefore need to CAREFULLY read and fully understand these terms and if you do not agree with them, you must not proceed to activate/register for and/or subsequently use the Airtel Virtual Card.
C. You acknowledge and accept that Airtel offers the Virtual Card Service only by electronic means via the Airtel Selfcare Mobile App. Where these terms and conditions provide for the giving or issuing of any notice, consent, approval certificate or determination, the acceptance of these terms and conditions shall suffice.
D. It is your sole responsibility to determine whether the Card is suitable and adequate for your needs. You assume all risks associated with your use of the Card.
We have defined some words for consistency. These words are used herein exactly as defined. Singular words include the plural and vice versa.
"Agreement" means the agreements between you and Airtel which include these Terms and Conditions.
“Airtel” means Airtel Mobile Commerce Zambia Limited
“Conditions of Use” means these terms and conditions as may be varied by us from time to time.
“3D Secure Code” means the one-time PIN (OTP) that may be required for you to complete a Transaction.
"Card” or “Virtual Card" means the Airtel Virtual Card which you can use to pay for Transactions online. The Card is not a physical card (no actual plastic card is issued.
"Card Purchase" means any transaction whereby the Card is used as payment for goods and/or services at online Participating Retailers.
“Cardholder” means an Airtel customer who receives Card credentials or activates the Virtual Card on the Selfcare App and is responsible for all transactions and liability on the Card.
“Card account” means the e-value account opened in the names of the customer upon activation of the card on the Airtel selfcare app.
“Cash” means the lawful currency of the Republic of Zambia.
“Credential” or “Card Credentials” means the combination of the Card Number (allocated to you when you opt in to the Card service); and the CVC sent to you via SMS each time you make a request to use the Virtual Card to complete payments.
“CVC” meansthe card verification code, a code that can be viewed on the Mobile App.
“Airtel GSM” means a mobile network operator providing telecommunications services within the Republic of Zambia and licensed by the Communication Authority who provide SIM Cards to customers.
“Airtel’s GSM Network” means the GSM System for mobile telecommunications operated by Airtel Networks Zambia Plc in Zambia;
“Airtel Money Account” means the Airtel mobile money wallet where customer’s e-value, being the record maintained by Airtel Mobile Commerce Zambia Limited stored in the customer’s name.
“Airtel Money Services” means the services provided by Airtel for the of E-Value and the transfer of E-Value between E-Value Accounts on the basis of instructions given by SMS through the Airtel Money Network and the Airtel Money System including the recording and confirming of all such transactions concluded and updating E-Value Account records.
“Airtel Money System” means the System/platform operated by Airtel Money providing the Airtel Money Services through Airtel’s GSM Network.
“Charges” means the Tariffs and other charges payable under this Agreement.
“E-Value” means the electronic value recorded in an Airtel Money Account, such electronic value representing that E-Value Account holder’s entitlement to an equivalent amount of the Real Money held in Airtel’s designated Trust Account.
“KYC” means All the “know your customer” information and documents that are required by compliance laws.
“Mobile Equipment” means your Mobile Phone and SIM Card or other equipment which when used together allows you to access to Virtual Card Services.
“Mobile Phone” means your mobile phone handset.
“PIN” means your personal identification number being the secret code you choose to access and operate your Card Account or Airtel Money Account.
"Participating Retailer" means an online merchant or supplier of goods and/or services who has agreed to accept the Card as payment for goods and/or services.
"Virtual Card Number" means the 16-digit Virtual Card number generated using the Self care App, when used alone or in combination with the expiry date and/or the CVC code indicated on the Virtual Card can transact on the Mastercard network.
“Self-care App, Mobile App” means Airtel mobile application that allows the customer to perform Airtel Money services.
“Third-party App’ meansany mobile application belonging to a third party, such as a Participating Retailer.
“Transaction” means any online transaction (through a website, telephone or mobile application), including Third-party Apps, eCommerce transactions, mail order telephone order transactions, in-app purchases and scan-to-pay transactions, in terms of which you use your Card to pay a Participating Retailer for their products or services.
“We” or “Us “or “Our” means Airtel Mobile Commerce Zambia Limited
“Website” means Our website at https://www.airtel.co.zm/airtel_money
“You”, “Your”, “Yours” Refers to the Airtel customer who has downloaded and registered for the Mobile App and is the activator and/or user of the Card.
1. Variation
a) We may update or modify these Terms from time to time. Such changes will take effect as soon as they have been published on our Mobile App or website.
b) By creating or using the card, you acknowledge and agree that it is your responsibility to regularly review the most current version of these Terms and Conditions.
c) Continued use of the Card following any changes constitutes your acceptance of those changes.
d) It is your responsibility to ensure that your contact details are accurate and up to date.
e) If any of your information changes, please update it promptly by visiting any Airtel Customer Service Centre or through the Mobile App.
2. Creating a card
a) You can create a Card at any time through the Mobile App by following the necessary prompts.
b) Your Card will be ready for use once you have completed all the necessary prompts.
c) You are required to fulfil all your KYC obligations prior to creating a Card.
d) Each Card will have a unique Virtual Card number and a unique CVC number and shall be linked to your Card Account.
e) The issued card will be valid for 12 months from the date of issue after which you are required to renew it.
f) The Card will be issued in your name as it appears on your Airtel Money Account.
3. Use of a card
a) You can use a card to buy products or services from any participating retailer that accepts Mastercard Virtual Card Transactions. Once a transaction has been completed using the card, it is considered final and cannot be cancelled, reversed or stopped.
b) You agree that you will not use a Card in any manner that violates any applicable laws, regulations or terms and conditions of your Card Account.
c) It is your responsibility to ensure that your use of the card complies with all relevant legal requirements at all times.
d) It is important to keep an eye on your card’s available balance to ensure you have enough funds for your purchase. Your available balance is also limited by the spend limit you’ve set on the card.
e) You can check your balance and adjust your spend limit anytime using the Airtel Mobile App or by visiting an Airtel Customer Service Centre.
f) You may be required to enter your 3D Secure Code to complete a transaction.
g) The 3D Secure Code adds an extra layer of security when making purchases, participating retailers will never see this code. However, you may not always be asked to enter a CVC or a 3D Secure Code to complete a purchase. For this reason, always make sure you trust the retailer and are ready to proceed before sharing your card details.
h) Unless you notify us otherwise, we will assume that any use of the card has been made by you or with your permission.
i) In line with applicable regulations, Airtel reserves the right to request further information pertaining to transactions made on the card , failure to provide information may result in limitation on usage of the Virtual Card including suspension or termination of the Card account.
j) It is your responsibility to monitor your card balance and ensure funds are available on the card prior to making purchases.
k) We are not responsible for any loss or damage resulting from unauthorized transactions that occur due to negligence, theft, misuse of the card or failure to safeguard your card details.
l) If you suspect any unauthorized use of your card or card credentials, you must notify us immediately by contacting Airtel Customer Support or visiting your nearest Airtel Service Centre.
m) You may be held liable for any losses incurred by any other party due to unauthorized use of a Card.
n) Online Card payments are subject to laws and regulations including any exchange rate control regulations. You may therefore be required to pay the Participating Retailers at the prevailing exchange rate which may fluctuate before settlement or completion of payment and shipment.
o) Your PIN and or Virtual Card credential (Card number or CVC number) will be blocked if you enter incorrect Credentials more than three (3) times. You will then be required to contact our Customer Care or visit our retail shops to enable us to restore your Card upon successful Customer Due Diligence.
4. Your responsibility
You are responsible for:
i. Keeping your card details confidential and secure at all times.
ii. All activities that occur using your Cards, including all activities of any persons who are in possession of your Cards, with or without your permission.
iii. Verifying the transaction details including the details of the participating retailer. We shall not be responsible for any loss incurred as a result of entering incorrect transaction details.
5. Transactions Disputes
a) Each Transaction is subject to the Participating Retailer’s specific terms and conditions and is a contract directly made between you and the relevant Participant Retailer.
b) If you wish to dispute any Transaction made with a Card, you must contact the Participating Retailer directly as the transaction was made between you and the retailer with whom you entered into the Transaction.
c) We shall not be liable for defects or fraud or poor goods or services by a Participating Retailer.
d) We shall not be liable for payments made to an unintended recipient using your Card. Any queries or complaints about such goods or services should be addressed to the relevant Participating Retailer(s). We shall not be responsible for resolving disputes related to the quality, delivery or refund of goods or services purchased using the card.
e) A dispute between you and a participating Merchant will not affect or stop any initiate transactions from completion and We shall not be responsible for any losses or cost you have incurred related to such dispute
6. Fees and Charges
a) You will not be charged any fees to create/activate a Card.
b) All Fees and Charges will be debited directly through your Card from your Card Account.
7. Expiry and cancellation of a card
a) Each Card is valid until the expiry date. However, you can easily extend the expiry date through the Airtel Mobile App before the card expires.
b) You may cancel your Card at any time by using the Airtel Mobile App. Once cancelled or expired, the card can no longer be used for transactions.
c) You can create a new card after the previous card is expired or cancelled
d) If you use a Card for recurring or subscription Transactions and the Card expires or is cancelled, you will be required to create a new Card and update the details of the Card with the relevant Participating Retailers.
e) Since every Card is linked to your Card Account, any available balance remaining on a card at the time of expiry or cancellation will not be lost. The funds will remain safe in your card account and can be used with a new or renewed card.
8. Third party apps
a) Any Third-party App will be subject to the privacy notice or terms of use applicable to such Third-party App. It is your responsibility to review the relevant policies before submitting your information to the Third-party App, and you provide your information at your own risk.
b) You indemnify us from any losses or damages you may suffer as a result of your access to or use of any Third-party App.
c) You hereby agree that we are not liable for any of the following:
i) The content, security, operation, use, accuracy or completeness of any Third-party Apps or of the products or services that maybe offered or obtained through them;
ii) The accuracy, completeness or reliability of any information obtained from a Third-party App;
iii) The ownership or right of use of any licensor of any software provided through any Third-party App;
iv) Any content featured on Third-party Apps that are accessed through the links found on the Mobile App;
v) Any failure or problem that affects the products or services obtained through a Third-party App, for example from any
vi) Any Transactions that you carried out using your Card on a Third party App are subject to these Terms.
9. Statements
a) You will be able to view your balance or see your recent transaction history through the Mobile App.
10.Warranties (Promises) made by you
You confirm that:
a) you are at least 18 years of age;
b) you are authorized to accept these Terms.
c) you are able to enter into a contract (you have full contractual capacity) and no court has declared you mentally unfit to do so;
d) you are not listed on any sanctions list of prohibited or restricted parties.
e) you have given us the right information; and
f) you read and understood these Terms before you created a Card.
11.Disclosure And Data Retention
a) By accepting these terms and conditions, you agree that you have read and understood and accept to be bound by our privacy statement which is available on our website
b) You hereby expressly consent and authorize Airtel to disclose any personal data, transaction data or information pertaining to your Card Account or Airtel Money Account to any law enforcement or regulatory authority and any third party to which you have separately, either in writing or electronically through the Airtel Money Account, Card Account or otherwise.
c) You acknowledge that where your Card Account or Airtel Money is determined by a competent judicial authority as containing proceeds of any criminal or money laundering activities, Airtel may be required by law to surrender funds in your account to any statutory fund created for the purpose of recovering the proceeds crime.
d) You acknowledge that Airtel may retain your personal data and transaction data as may be required by any law or regulation.
e) You acknowledge that by using the Card, some of your personal information will be passed on to any person with whom you make a transaction in line with this Agreement.
f) Airtel collects personally identifiable information that we use to profile Virtual Card Service Users and administer individual Card accounts, update our databases, in order to provide User support.
g) Save as provided hereunder, Airtel does not share your personal information with unauthorized persons and adequate safeguards have been put in place to prevent unauthorized access and to ensure confidentiality of your personal information.
12. Intellectual property
a) We will always be the owner of every Card.
b) All intellectual property rights in connection with a Card belong to us and/or our licensors. You do not have any intellectual property rights in any Card, or in any improvements or variations that may be made to them.
13. General
a) The Terms and the relationship between us and you are governed by the laws of the Republic of Zambia.
b) These Terms apply together with the Mobile App Terms, which include the privacy and security statement, and any other relevant terms, conditions and disclaimers are incorporated by reference into these Terms. If there is a difference between the Terms and the Mobile App Terms, the Terms will apply.
c) Any references to legislation, rules or regulations will refer to the latest versions thereof as updated from time to time.
d) If any clause of the Terms is invalid, illegal or unenforceable, it will not affect the validity, legality or enforceability of the remaining clauses.
e) If we do not exercise or enforce any right or provision of the terms, this will not constitute a waiver of such right or provision.
f) Any dispute arising out of or in connection with this Agreement shall be referred to a competent jurisdiction in the Republic of Zambia.
14. Notices
a) We are entitled to send information to you via SMS or through the mobile app to the contact information as supplied on your KYC. These SMS are for information purposes only.
